How Bail in Maryland Works

  1. What is a bail bond?
A bail bond is simply something used to get someone who is in jail out. It is the instrument used by the judicial system to help ensure the defendant returns to fulfill his duties to the courts.
  2. How much does it cost?
Bonds for bail in Maryland are a standard 10% of the total bail amount. For example if the bail bond amount is $1,000, it would cost $100 to have a bail bondsman post the bond.
  3. How long does it take to get out of jail once I post bail?
There are many things that affect how long it takes for someone to be released once a bail in Maryland is posted. The county, day of the week, time of day, volume of releases and holding/detention center all play a factor. Usually, our clients are released between 2–8 hours after we post their bond. Again, this varies on a case-to-case basis.
  4. Who can post a bail bond?
Anyone can post bail in Maryland. Again on a case-by-case basis there are different requirements and it is usually best to seek the advice of a bail bondsman licensed in Maryland to help.
  5. Do all bail bondsmen charge the same amount?
In the state of Maryland a bail bondsman is allowed to charge 10% of the bail bond amount, no more and no less!
  6. What if I don’t have all of the money immediately?
Don’t worry—you can still release your loved one or friend from jail. Payment plans are available and depending on the length of repayment and amount down, payments can be extremely affordable.
  7. Do I have to be a resident of Maryland to post a bail in Maryland?
You do not. Extra steps may be needed to get your bail approved; however, it is not mandatory.
  8. Am I responsible if I post bail in Maryland and the person doesn’t show?
You are responsible for anyone for whom you post bail. While about less than 1% of bailees don’t appear on time, it can and does happen. Usually this situation can be resolved with assistance from the defendant’s lawyer and bail bondsman.
  9. Do I get my money back once I go to court? What if I am found innocent?
Unfortunately, no. The amount you pay your bail bondsman is a non-refundable fee that allows you to leave jail until you can handle your legal obligations. Regardless of the outcome of the charges, the fee you pay is simply for your “get out of jail” card.
  10. Are bail bonds different everywhere?
Like everything else, bail bonds in Maryland can vary county to county, city to city and especially from state to state. You should always contact a licensed bail bondsman for guidelines in specific areas and counties.
  11. Are there any restrictions when someone is out on bail?
Terms of any one specific bail bond will vary. Sometimes the court will have specific rules a defendant must follow. In other cases, the bail bondsman has the right to outline more specific terms should they believe it necessary.
  12. What is Bail Review?
Bail reviews are court hearings to review bail amounts that could be too high or low for the charges and or prior record of the defendant. Many times higher bails are reduced to allow the defendant a better chance of getting bailed out of jail. A defendant’s lawyer can explain details or vouch for a defendant’s character.
  13. What if I don’t want to be responsible anymore for someone I bail out?
If you ever feel someone you bailed out of jail is a risk to his or her self or others, contact your bail bondsman immediately.
  14. Is there a maximum amount for bail in Maryland?
There is no maximum or minimum amount for bail in Maryland.
  15. Who determines the amount of a bail bond?
A judge or commissioner sets or reviews a bail amount both at the initial hearing and any following bail reviews. Every situation is different and there is no set guideline therefore it is impossible to determine what any one judge or commissioner will decide.
